divorce and bankruptcy

Filed bankruptcy chapter 13, finalized in March. i want a divorce

now, husband refuses to leave the house. I just need to know what

I can do. I want to keep the house and our 3 year old obviously.

The bankruptcy garnishment takes my whole payment except

$11.49 every two week...he is saying I have to leave and he is the

one gettng a pay check every day. The bankruptcy and the bills

our in both our names. He can go live with family and pay hardly

nothing, I have no where to go. How and can I get hiim out and get

1/2 of his check???

Who is paying your house payment. You need to see a lawyer, file for divorce, get a court order requiring your husband to pay your attorney, get either a status quo order or an order for child support that will be a wage assignment. Depending on how bad it is at home, he may or may not be required to move now. However, at the end, one of you will have to leave the house. If you wish, give me a call at 248-353-9400. Bill Stern
