Divorce & credit card debt

After 33 years of marriage my

husband and I are planning to

divorce in Michigan. We have

separate charge accounts without

the others name on the charge

cards. Will we be obligated to pay the

others credit card debt? What if we

agree in writing not to be responsible

for the others debt in our

settlement?

Re: Divorce & credit card debt

Neither of you will be responsible for the debts of the other, unless you agree otherwise, or unless the judge determines that the debt is so one-sided that the equitable thing to do would be to share it. That seldom happens.

And anything you agree to with each other in writing will be enforced, so be careful. Consider letting a lawyer read whatever you are asked to sign before you do so.
