Legal Question in Family Law in Michigan
Divorce
I have a female friend that has recently filed for divorce. Nothing is final yet in the case, but its simply because she hasnt received a court date yet. Her and i have been seeing each other, but not intimately. We have only been doing things like going out to dinner or going out and doing activities such as movies or bowling. Her (soon-to-be) ex husband is threatening her that he is going to file suite against her saying she is having an affair with myself while she is still technically married to him. Is he able to do this even though she has already filed for divorce and made it clear she no longer wants to be with him? Or is there nothing for her to worry about?

Re: Divorce
He can make the allegation. Michigan is typically a no-fault state. So generally it is not going to matter whether she is having an alleged affair or not. However, he could use the claim that she is having an affair to try to gain a higher interest in any property they might have or if they have kids to claim that she would be exposing the kids to a stranger. Hopefully, she will get a judge that will see through the crap and if he makes the allegation, she should demand that he provide tangible proof.
