Legal Question in Family Law in Michigan
"Divorce laws in the state of Michigan."
In July of 1997, my husband and I separated. My choice. I moved out into a house of my own. He stayed at the house we'd lived in approximately 5 years with the two children (ages 16 and 18). What are the Michigan divorce laws? What am I entitled to? Does my moving out affect what I would be entitled to? I have very little money. How would this affect my getting legal help?

Michigan Divorce
Michigan is a no fault divorce state. That means that either party may request a divorce without having to prove fault. The only requirements are that you have resided in the state for at least 180 days and in the county of filing for 10 days prior. You should be eligible for an equitable split of the marital property and may be entitled to spousal support. As it appears that your children are residing with their father you may be required to provide child support. You would be entitled to visitation with your children. It is important that you speak with an attorney face to face to fully discuss your rights and obligations. You may want to check with your local legal aid to see if you qualify for free or reduced legal assistance concerning your divorce,
