Divorce & Property Settlement

Is it ever advisable for a party in a

divorce to not be represented by an

attorney when the other party has a

very aggressive attorney? The

divorce is mutual but the property

settlement and child custody are

very contentious issues. My ex is

trying to get me to attend the

settlement conference without

representation.

No, while there are situations where individuals can represent themselves in divorce proceedings, I cannot recommend that course in your situation.

Your spouse has clearly hired someone to look out for their interest regarding custody of the children and property distribution, and you need to do the same. You need to find a good family law/divorce attorney as soon as possible, and you should not go to a settlement conference on your own.

I suspect that you already know that taking advice from you soon-to-be ex spouse is silly. I also suspect that you already know that you should hire the very best lawyer you can find to protect you.

NO. The mere fact that you are asking this tells me you are concerned enough. You need to make sure you aren't screwed over - which is why your ex is trying to dissuade you from having legal counsel. Get a lawyer immediately before anything is finalized or put in an order. Undoing something you have agreed to will be very difficult, and expensive.
