Divorce residency requirements

My husband and I have resided in Florida for over four years, but have a marriage license in Michigan; Do we have to file in Michigan or Florida?

Jurisdiction for divorce rests where the Plaintiff resides. As long as the Plaintiff has been in the State for the requisite period of time (varies by state). In your case, it appears that you have jurisdiction in Florida. For more info, please contact my office at (248)851-3171.

Where you received your marriage license has nothing to do with where you file for divorce. In Michigan, you must live in the state for more than 6 months and within the county in which you file for more than 10 days. I assume Florida is similar. William s. Stern
