Legal Question in Family Law in Michigan

divorce and retirement

I work for the post office and I believe my husband will get half my retirement income if I divorce him. He has no retirement. He is counting on inheriting a large sum of money when his parents die. Is there any way I can keep my whole retirement to myself so I won't be in poverty while he inherits millions. I don't like the idea of waiting for his parents to die so that I get half the inheritance.

Re: divorce and retirement

No, he is probably entitled to half of your retirement, and you in turn, are not entitled to any of his inheritance. This is plain Michigan law. www.kliszlaw.com Tim Klisz

Because there is property involved, it is important that you have a competent attorney handle your divorce. An attorney can draft a settlement agreement that can protect you and your pension. In addition, if you divorce him, unless it is in the divorce judgment you would not be entitled to his inheritance. Our office has experience with these matters. Contact us if you need help with this.
