Legal Question in Family Law in Michigan

Can a divorce settelment be taken back to court?

Can a divorce settelment be taken back into court? I feel my attorney did not represent me fairly. I was married for 19 years when this was filed. A home was paid for,I had worked 19 years, children grown, wife worked about 5 years. We seperated ,she filed,we went to court. The judge stated that he didn't believe that I lived in the home and awarded her the home, gave me 50% of her pension, she 45% of mine. The problem, any increases i recieve she gets,an any other payments that might occur she will recieve also. When will it stop. This is like being raped by the judge. this occured in 1999.

Re: Can a divorce settelment be taken back to court?

Dear Sir:

This is in response to your email of August 31, 2001, which this office received on October 1, 2001.

Anyone can file a motion to have a judgment of divorce modified. However, there must be certain legal grounds for doing so such as an inadvertent mistake, fraud, etc.

It sounds to me that your complaint is that you did not like the way that you were represented or the way the judge ruled. You could have filed an appeal with the Court of Appeals. However, the time limit for doing so has probably expired long ago. As such, I believe that you would have very little chance of getting your judgment changed.

Sincerely,

Charles L. Nichols
