Legal Question in Family Law in Michigan

Divorce and taxes

When my ex-husband filed for divorce and then moved to Texas, he was required to pay my health care for 3 years (COBRA). After two years, he now says that is income for me (I must pay taxes on it) and a deductable for him. The divorce decree states that alimony is income for me, but, located in another section, there is no reference to the health insurance as being income for me. Do I have to declare it on my income tax? What about last year?

Re: Divorce and taxes

First, don't get legal advice from your ex. Second, contact your divorce attorney. Third, in order to be classified as alimony, the law sets forth very specific requirments and wording. Although it does not sound like you have a problem PRELIMINARILY, you should still have this matter reviewed by your lawyer and/or a trusted tax attorney to be certain.
