Divorce

I am getting a divorce after 25 years of marriage and I am currently seeking counseling for depression. My husband keeps saying that I am crazy and a drug addict because I am currently taking Xanax and zooloft for the depression. Can that be used against me in the divorce?

Probably not. Your attorney should be able to deal with your husband.

The only possible benefit to your husband in using the drug info would be on a property resolution or regarding custody. I wouldn't worry about the property aspect because it is ridiculous to even worry about it. As far as custody, your mental state could be an issue but half the world is on those drugs so judges don't consider it a negative. You can always take the position that the depression was caused by being married to him! William S. Stern

There is nothing wrong with receiving treatment for depression and/or using medications for it. As long as your medical situation does not affect your ability to care for your children, it should not affect your ability to obtain custody or affect any other aspects of your divorce. He is the one probably causing the depression - not your fault!
