Divorce/Mortgage Equity Payment

Fiance divorced Dec. 2002. He must pay ex-wife approx. $15,000 for house equity before Dec. 2007. She holds a mortage on the house after the lending company. He wants to refinance for lower interest rate but she refuses to sign legal form to go back into second place after new mortgage is signed. Is there any way that he can set aside in a cd or savings bonds, etc. the amount due to her but not pay her before the time required?

The problem appears to be that he needs her signature on the documents but she will not give it. The remedy is to file a motion before the judge who entered the divorce and force her to sign the documents or obtain a court order waiving her signature.
