Legal Question in Family Law in Michigan
document agreeing to custody change
I have a court date for May 3rd to change custody of my daughter who is 8. Her father is having problems with her at his home and so he decided to take her to see doctors at U of M child psychiatry center. The doctor there along with both sets of parents agreed to a change in caregivers and I have the medical document to take to court with me. My question is can I get my daughter before hand with an attorney's help and get the court date moved to a sooner time? I chose to represent myself because I do not have the average retainer fee for an attorney.

Re: document agreeing to custody change
If both the custodial and non-sutodial parents agree to change custody they may do so (providing the FIA or Juvenile Court are not involved). Once the document is drawn up you should bring it to the FOC and have them enter it. Once accepted by the court you can request to cancel the May hearing date. Be sure to include the amount of child support you would be requesting and agreeing to as well as parenting time for the non-custodial parent. If you are both in agreement you do not need an attorney. Good luck.
