Legal Question in Family Law in Michigan

EDRO Summons Clarification

I have tried to have an EDRO signed by my ex-wife for retirement account dispersion to no avail. I would like to file a 7 day summons in order to avoid this confrontation. Is there a summons template available on-line to use so that I can do the legal work myself?

Re: EDRO Summons Clarification

There is no such thing as a "seven days summons." There is something called a "seven day rule." The seven day rule allows a party to submit a proposed order that is consistent with a judge's previous ruling and have it signed by the judge if there are no objections within 7 days. However, by definition is requires that the judge has already ruled on the matter. It sounds to me like you need to file a Motion for Entry of Order. That will require the motion and the proposed order (EDRO). Feel free to call if you need to retain counsel. John C. Talpos (http://www.Mich-Lawyer.com)
