Legal Question in Family Law in Michigan

never ending divorce

I filed for divorce one year ago. My ex and I were not able to agree on anything, and were sent to mediation. The judge said there were too many remaining issues, and sent us to arbitration. The judgement of arbitration was finished and we went to court for the fourth time. My ex objected to the parenting time despite agreeing to the arbitration and the judge agreed with her, stating the parenting time schedule needs redone. She gave no specifics to what she feels should be changed. My attorney said this judge does these things all the time. I cannot afford my attorney at this point or another arbitration fee. How many times can the judge do this? We are in Wayne County.

Re: never ending divorce

The problem is, the arbitration statute does not allow the arbitrator to ultimately decide all things.....mainly property issues and some parenting issues. However, if one side objects, the judge has the duty to decide the issue. William S. Stern
