Legal Question in Family Law in Michigan

ex-husband did not file the necessary papers

After the final hearing of our divorce, my ex-husband (plaintiff) did not send me a certified copy of the divorce papers, nor file a proof of service with the friend of the court. Subsequently, I was not given any information on when or where to pay my court ordered child support. Note: in court for our final hearing I specifically asked the judge if I would be given ample notification of when and where to pay, I was assured ''yes''. I have not paid any support as of yet, however I am supporting all of my childrens needs at this time financially. He has full physical and half legal custody. I have now been served with a petition and order to show cause for contempt (support). My question is this, since he did not file the necessary papers in a timely manner, do I have any legal recourse as far as back support? Thank you in advance for you answer.

To Whom It May Concern:

This is in response to your email of September 25, 2001, which this office received on November 6, 2001.

In my opinion, you have no legal recourse for back support. However, you may be able to obtain some credit for some of your childrens needs for which you have paid.

Sincerely,
