Legal Question in Family Law in Michigan

ExHusband Fraudulantly Claiming Child on taxes

My ex-husband fraudulantly claimed our daughter on his taxes for the year of 2001. In the decree, it does state that he is awarded her as a tax exemption. For any year he is current on child support payments as of December 31. Which is NOT the case here. He is still paying arrearages through Friend of The Court. I have documentation stating this is the case. What are my legal options in this matter? Can I file an amended tax return and add her as a tax exemption? File a motion with the court to enforce the decree? Or should it be directed elsewhere? Any advice will be greatly Appreciated! Thank You!!!

Greetings; Your best option would be to file a motion to enforce the decree. The judge will fashion the most appropriate remedy. Thanks, atty. Trichler; www.trichler.com
