Legal Question in Family Law in Michigan
Failure to pay child support
Its my understanding that failure to pay child support can be a Felony in Michigan. My question is what is the minimum balance for arrearage before charges are typically brought against the non-complying party? What ''sentence'' does such a charge normally result in?

Any arrearage is considered a crime. If your payments are through the Friend of the Court, they will schedule a show cause hearing for the non-paying parent, and then proceed to issue a bench warrant if the amount is not paid. If you do not go through the Friend of the Court, then you have to contact them to initiate proceedings and tell them how far the payments are so they can start the proceedings (show cause hearing, etc). How quickly they act depends upon the county.
