A Fathers Rights Question
My divorce was final this past December of 2005. My ex wife and I have a three and a half year old son with autism. I am having some concerns with our child's day care provider. This day care provider is a niece of a friend of my ex-wife's. She is not a licensed nor certified day care provider let alone someone with experience with a special needs child.
My ex hired her full time without my consent but I initially did not fight or address the issue during our divorce proceedings because initially she appeared to work out ok with my son. Now that the divorce is final I often call to check up on my son but the current day care provider hardly ever answers the phone and only occasionally will return my phone calls. My ex also does not always use her everyday during the week since she has many vacation days and time off with her job yet I am still charged the full weekly amount for day care via Friend Of The Court, even if the current day care provider is not used that week.
My question is can I legally request or forcibly change day care providers even though my ex will probably disagree or fight me on this.
