Legal Question in Family Law in Michigan

File a motion

My exhusband is an attorney and we have been legally divorced for 5 years. Whenever we disagree on something that he feels is important to him and I feel that it isn't in the best interest of our children then he files a motion against me in court because he can. I live 200 miles from where he practices law and also it is the same court that jurisdicts our divorce case. Currently he has asked me to allow our 3 minor children to be pulled out of school one week earlier than scheduled by the school district for Spring Break 2005. His wife and step-children have the prior week to our children's off. I will not entertain this as I feel it is not important and our children are small enough that a week would be a long time to catch up. Now I have to go to court in front of a referee because he can't get his way. This is harrassing and I would like to file a motion. How can I do this?

Re: File a motion

You can ask for sanctions for filing frivolous motions. They may or may not be granted. However, the best thing you could do is find a local, well connected attorney who doesn't like your ex to represent you. Bill Stern 248-353-9400
