Legal Question in Family Law in Michigan

Filing for child support in Michigan

When my divorce was first final, my ex and I had week on/week off custody, and since I made more money, I was paying him support, but we didn't go through FOC. Now, I have custody, he sees the kids every other weekend. I am trying to figure out which forms I need to fill out in order to get a child support order against him. Do I have to go before the judge to get a FOC case started, or can I go right to the FOC with the modification forms?

Re: Filing for child support in Michigan

In Michigan you can file your own request for a modification of child support on a friend of the court form. This form can be found at http://courts.michigan.gov/scao/courtforms/domesticrelations/support/foc50.pdf. There is a finling fee of $60.00. If it has been more than two years since your last modificaiton request you should be able to make a requests by letter to your FOC office for a review for free. The time it will take to process depends on which course you take and which county your case is in. Each county is a bit different. Good luch and call me if you need further help.
