Legal Question in Family Law in Michigan
FOC drops case
Hello, I spent 6 years trying to get custody of my daughter, and arguing with the FOC on child support issues. After a lengthy battle for custody in court, which I lost, 6 weeks later the mother ended up in federal prison, attempted suicide and did pretty much everything that I had said she was doing. I tried to put the people from the FOC on the stand and they used the usual ''I can't recall'' line. I had the FOC in Oceana remove himself, due to being a mediator. He also made statements that the judge was tired of my case, which I put in a greiveance. Anyhow, it must have peed them off, because I called and asked for their assistance when the mother asked for visitation. The reply was, that they had closed our case. This was 7 months after I was awarded custody, and I didnt ask for child support. Is it all about money? Where's the best interest of the child come into play here? Can they do this and shouldn't we have been notified, or isn't it a court action? TY

Re: FOC drops case
I'm sorry to hear about your terrible experience. I believe you said that this was in Oceana County? Unfortunately, I to often see what amounts to a miscarriage of justice, especially with family court matters. The system is imperfect and if you are dealing with people who have petty egos, you often get results like this one. I am glad that you have custody of your child now. Did you ever have a lawyer during the pendency of the proceedings? It might have made a difference. You are correct that the standard is "the best interests of the child." Without seeing all the transcripts and pleadings, it is difficult for me to say what went wrong in your case. For more info, please contact my office at (248)851-3171.
