Legal Question in Family Law in Michigan

Which forms to use for MIchigan divorce?

I'm filing for a non contested divorce. We have 4 children, ages 18-25. None of them live with either of us. The ''Complaint for divorce- adult children'' form states ''All children of the marriage are over the age of 21 and emancipated.'' The other form was a ''complaint for divorce with no children. I'm not sure whick to use, as our 2 youngest are 18 & 19, but they are emancipated. Do they have to be over 21 AND emancipated to use the ''Complaint for divorce with adult children'' form or can I use the ''complaint for divorce-no children'' form? Thank you.

You should take these forms to your family law attorney for review. It is probable that the attorney won't use forms since they are often deficient. Generally speaking, attorneys prefer to draft their own documents correctly rather than to use forms that are often lacking in one way or another.

This is the problem with using "box forms" that are not from Michigan. Our laws are different and neither of those forms are correct. Your divorce is one without children because all of the children are older than 18 and are emancipated.
