Legal Question in Family Law in Michigan

Foster care

My girlfriend's Mom and Step Dad, told her to get out of the house, just with the clothes on her back. She did, she now lives with me (her boyfriend, and with my family) Her Real Dad doesnt really care whats going on. Her Real Mom has child custody. Shes been going back and forth between her Real mom and Real Dad all of her life. She is now with me. We have a court date to try to get her emancipated, so her mom couldnt take her back anytime she wanted. If the court emancipation doesnt go through. Could my girlfriends real Mom, take my girlfriend and put her in some kind of home. FOSTER HOME ETC. My understanding you can leave home at 17 and parents cant do anything about it. I understand that if you go to a home, you cant leave until your 18. Is this true. My girlfriend has a job. She supports herself. We are just giving her a hand to get back on her feet. Is it possible at all for her mom to be able to get her in a foster care, just to be mean. Or are there certain rules and restrictions concerning this topic. Thank you for your time. Please Respond. Re: Foster care

Given what you've written, there doesn't seem to be any reason for the court NOT to grant the emancipation.

If she's 17 and already supporting herself, then by the time the court order would be appealed, she would be 18. No judge I've known is going to put her through that, particularly when her mother has already thrown her out.
