Legal Question in Family Law in Michigan

fraud on court

My wife obtained full custody of our child by lying to the court saying we were seperated and she didn't know where I was. Infact I was living in the home at the time and had no knowledge that she had even filed. After she was awarded custody she threw me out of the home. What can I do to get custody of my child now?

Hello, I have received a copy of your posting. Divorce and family litigation is one of our firm's areas of concentration. You need to establish that you were living at home at the time your wife filed for divorce. It would also help to obtain a transcript of anything she said in Court so that can be used against her. This is important because once custody has been properly determined the standard that must be met to change custody is that you show by "clear and convincing" evidence that the best interests of the children are served by changing custody.
