What do we have to do so my future husband can adopt my daughter?

I am going to get remarried in Oct. and my future husband would like to adopt my daughter from a previous marriage. Her father is in jail for the next 5 years. He signed a name change so she could have her last name the same as mine. I'm sure he would have a fit if he knew I was getting remarried and wanted my soon to be to adopt her. She is 5 years old and calls him daddy she doesn't ask about her real dad. I would like to have things happen before he got out but am not sure if it would be possible. He has to go to the court system to be able to see her again anyway. Please help. Thank you

Either your ex needs to consent to the adoption or you can apply for the step parent adoption to the court. For that, you would have to show that he has not seen her in two years or paid support in that time. You can't do either method of adoption until you are married, however.
