Legal Question in Family Law in Michigan

Health Insurance

My soon to be ex SIL lives in FL. He has 4 kids with my daughter and an 8 yo daughter, who his parental rights to were terminated when she was 5. He is saying that he is still court ordered to cover this child under his employer's health insurance and therefore can only cover 3 of his other children. He says the policy only allows 4 dependents. Also, he say the kids don't need insurance cards as Friend of Court has the necessary information. How can we verify any of this?

Re: Health Insurance

If his parental rights were terminated as to the 8 year old, then a court cannot order him to do anything for that child - whether it be pay child support or provide health insurance, so he is probably lying.

Even if he did have more than 4 children, if the courts are requiring him to provide health insurance, then he needs to find a way to provide it, whether it be listing them as dependents or paying for an additional policy. And yes, the children need insurance cards and verification that his insurance is valid, etc. You can contact the Friend of the Court to see if they have received any of that info.

If not, and he will not give it to you, you are going to have to hire a family law attorney in your county/area to file a motion to compel him to provide insurance and prove that he has insurance for all the children.

If you don't know of an attorney in your area, you can contact the attorney referral hotline at 800.968.0738 for a recommendation.

Thanks and good luck.
