Legal Question in Family Law in Michigan

we need to go home

my boys and i went to arizona to visit my side of the family a year ago this past august.the boys realized they wanted to move back.we got back to michigan we told my husband. his family is in michigan and for a year and a half have tried talking him out of it. he promises we can sell the house and move one day, then the next day he's angry and tells me to take the boys and get the hell out right now, he's going to keep the house. obviously we're not a happy couple and haven't been for years. my husband is a dead beat father, he does what he can to get out of working. his boys and i have worked for a long time now fending for ourselves. we want to go back home to be happy,and he said he doesn't want to let us be happy and if i do leave he'll get me for kidnapping his kids. am i legally able to leave???

Hello, I have received a copy of your e-mail regarding your desire to return to Arizona. yes, you can take the kids and move there. Check with an attorney in that state to find how long you have to be a resident of Arizona before you can file for divorce. I would then decide whether you want to file for divorce there or here. The problem with filing for divorce in Michigan is that you will have to get permission of the Court to move the children. If you have any other questions, feel free to call. Good Luck. John C.
