Legal Question in Family Law in Michigan

Hopeless

Because of religious reasons I cannot seek a divorce until adultry has been proven. My husband left me and will not sign for a legal separation. I want to buy a house and get on with my life. Am I stuck in this situation legally?

Greetings; No, you are not 'stuck'. You can file for separate maintenance. Michigan does not have legal separation. See a divorce attorney at once, they can file both types of actions. Thanks, Atty. Trichler; www.trichler.com

Hello, I have received a copy of your e-mail regarding your domestic situation. Yes, you are able to get on with your life within the teachings of your religion. Michigan recognizes what is called "separate maintenance" That is where all of the property rights of the parties are determined and they go on their own ways. However, they do remain married to each other and cannot remarry until a divorce is granted. He cannot stop you from bringing such an action. You should be aware, though, that if you file a seperate maintenance action, he can respond by changing it to a divorce matter. I do not know what your religious situation is if your spouse is the one seeking the divorce.
