Legal Question in Family Law in Michigan

My husband is not the biological father.

My husband is in the military and in 2001 we had a son. Well my son is not his. My husband knows that and signed the birth cirtificate. The biological father does not know about my son. I was wondering what kind of legal rights either of them have reguarding this and if my husband and I were to divorce would he still have to pay child support because I heard that once you sign the birth certificate you relinquish all rights.

Greetings; By law, your husband is the father of the child until a court changes his standing. If no court action is filed, the 'real' father has no rights. If a divorce action is filed, you husband "may" be able to prove that he is not the father. He does not have an ablosute right to do this. Good luck. Atty. Trichler; www.trichler.com
