Legal Question in Family Law in Michigan
My husband and I live in New Jersey. His 10 year old son lives in Michigan. He has not seen his son since he was 3 years old due to the mother constantly moving. He has paid child support consistently until he was laid off he is now working again and has started paying again. He has just found out the mother committed some type of fraud and will be going to jail his son and her other child (by another man) will be taken by child protective services.
What are his legal rights in getting custody of his son? He was not aware of his paternity until he was 2 years when he requested a paternity test (she wasn't sure who the father was) . Both of her parents are deceased and as far as he knows there are no other relatives on her side of the family to challenge custody. What does he need to do next, he called child protective services today and they told him someone would get back to him in two business days. We are afraid he son will get lost in the "system" in the mean time. Any help would be greatly appreciated.
