Legal Question in Family Law in Michigan

My ex husband is not reimbursing me for daycare as ordered in my decree. Friend of the court says I can't go through them because it was not written in the friend of the court portion of the decree. I was told I need to file with Judge Pazetti. What document am I supoosed to file? Where do I find it?

It is called a motion. The court filing fee is $20.00. I assume you need it done as inexpensively as possible. The problem is, if you get a lawyer, the lawyer has the ethical obligation and the requirement that the lawyer appear at the hearing. This literally will take 1/2 day by the time the lawyer goes to court, meets with the Friend of the Court and potentially has a hearing in front of a judge or referee. On top of that, if the referee makes a decision, there is the potential for an appeal to the judge. This does not even count the preparation and filing of the motion itself. In order to save these costs, a lawyer can prepare the document for you and have you sign your name to the document without the attorney signing. This way, you will appear at the hearing for yourself or in pro per. While there are some places to obtain in expensive legal help, it usually takes a long time and is kind of a 'pain'.
