Legal Question in Family Law in Michigan

Improper Influence

I have joint legal and physical custody of my son. His mom has been dating someone with numerous convictions. I have attempted to speak with her regarding the improper influence however, she does not agree. Is there something that I can do to restrict my son from being around this type of influence? I don't want to pursue full custody. I just want my child to have the proper role models in his life.

Re: Improper Influence

It seems you want it both ways. You want to tell your ex who she can see, but you don't want custody of your child. In these situations the way to get your ex to comply with your wishes is the tacit or implied threat that you will seek a change in custody. The court will find it difficult to fashion a remedy for your request. If she refuses to stop seeing her current paramour, what is the court to do? If you sought custody of the child, then the court could say, if you don't stop seeing this person who is a poor influence on the child, the court will order custody be changed to Dad. Without the option of a change in custody, I believe the court will be of little help. For more info, please contact my office at (248)851-3171.
