Legal Question in Family Law in Michigan

Inter-Family adoption

I have been asked by my sister, to adopt my nephews and his girlfiends daughter (1 yr old), since they are not able to to care for her. My sister is not financially able to care for her. I'm waiting to hear from my nephew and his girlfriend to make sure this is what they want.

What is the process I need to do, to get this started?

Will I need an attorney or is it possible to fill the paperwork out on my own?

Adoption is a big deal so you give it a great deal of thought. Perhaps you'd be better off with a simple guardianship which would give you legal authority over important decisions regarding the children without the permanent responsibility that goes along with adoption. If your concern is that the parents are unable to care for the child at this time but may be in a position to care for the child in the future then adoption is not the way to go. I suggest that you pursue a guardianship for the child. If however, the parents will never be in a position to care for the child then in order for the child to have a stable home environment then adoption is the way to go. You would be entitled to an adoption subsidy. You should contact an attorney to assist you in either an adoption or guardianship. If the MFIA (CPS) is involved let your desires be known to the case worker and they can assist you in the guardianship or the adoption. Good luck.
