Legal Question in Family Law in Michigan

Issuing a Subpoena

Is there an ''expiration'' on a subpoena - meaning if I am subpoenaing someone to appear at a trial, is it possible to subponea them too early? Can I subpoena someone in March for a trial in June?

Thanks in advance!

Jill

Re: Issuing a Subpoena

You are okay. If you subpoena someone too late, you have a problem......not too early. Don't forget to include the proper witness fee or else the subpoena is not effective. Bill Stern 248-353-9400

Re: Issuing a Subpoena

The witness supoena by its nature commands a person to appear at a certain place (the court) and date/time. That serves as the deadline for service. However, there is always the risk of serving a subpoena too early, if you do not give the witness reasonable time(at least 2 days before the witness is to appear). As another lawguru attorney has noted, don't forget to send the proper witness fee along with the subpoena! www.lawgreg.com
