Legal Question in Family Law in Michigan

jurisdiction of court child custody

My ex boyfriend and I have a 3 yr old daughter. If an order of custody is standing in Michigan where I reside, and he's currently in Arizona, {she's only been there since March 31 st 2008} is there any way he could obtain sole custody of her?

Re: jurisdiction of court child custody

Which court has jurisdiction has no bearing on whether he can seek and obtain full custody of the child. He can try to do that anytime, in any court.

If you need to otherwise know which court has jurisdiction over the child and her case, you'd have to look at your paperwork. It is likely Michigan, if you have sole or the majority physical custody of her.

If he initiates proceedings in Ariz, dispute them by arguing that Mich has jurisdiction over the child, so then he has to fight his battle here.

Re: jurisdiction of court child custody

If there is a custody order in Michigan then that Court has continuing jurisdiction. He cannot change custody to another state without filing a motion here and requesting to transfer the case to another state. Whatever happens you should be notified. If you are concerned that he has filed something in Arizona you may want to contact an attorney to look into the matter for you.
