what effect does having an affair have on getting custody of your child?

Normally, a person having an affair may not impact the custody issue at all. However, what happens is that people involved in the affair lose their senses and start integrating the child or children with the other person. This can create a great deal of confusion for the child and may alter a judge's opinion as to what is in the best interests of the child. Also, it goes without saying that if the quality of the child's life was sacrificed by the affair, it could alter a judge's decision. It is only one factor among many. William S. Stern

An affair can indeed have an influence over the court's decision in a custody case. It may play into one or more of the factors that the court MUST consider in determining custody. You should be retaining an experienced family law attorney if you intend to fight for custody.
