land contract
Hello,
My wife had left home about 7 months now taking her daughter with her, this is my step daughter.They got an apartment.
Our daughter together stills lives here at the house with me. It looks as though we may end up in a divorce. I have had huge finatual problems since she left. I havent been able to make my land contract payments the house may be getting reposessed for nonpayment. The holder on the house just happends to be my father. I will continue to rent from him till I am able to get back on my feet.
My question is what type of posision will this leave on my wife? soon to be X Will I have to pay her anything for this? What posision will this leave me in. during court?

Although your question is somewhat complex, you should understand that there is no black/white answer. Much of divorce law is shades if gray. However, based upon 28 years experience, my guess is that your financial problems that started after she left are not going to be her problem. You will not have to pay child support for the child she took with her as I assume someone else is responsible for that. However, since you have the child that you have in common with her, you should rush over to a family law lawyer and start the case so that you get an order getting you custody. If there is no chance of reconciling, you should file for divorce immediately. Perhaps you can get a court order to compell her to help make payments on the house. The divorce should be commenced before you lose the house. Also, you could seek custody of your daughter in the divorce. For more info, please contact my office at (248)851-3171.
