Legal Question in Family Law in Michigan
Legal custody
My husband shares joint legal custody of his 12-year-old daughter with his ex-wife. She currently has sole physical custody; My husband filed a motion for sole physical custody. It will be approximately 3 months until they begin the Friend of the Court investigation. Yesterday, my husband's ex-wife moved for the 4th time in less than 3 years. Every time she moves, my stepdaughter changes schools. As they have joint legal custdoy, and he should have a voice in his daughter's schooling, is there ANYTHING we can do? Or do we have to wait for 4 months, until the FOC investigation is complete? My husband does not want his daughter changing schools yet again.

Re: Legal custody
Greetings; Yes, there is something you can do. You can file a motion for immediate relief. This is not an easy motion and you will need an attorney. I have handled many such motions. Kindly give me a call tomorrow. 616-457-5100; www.trichler.com.

You must file an emergency motion. The court may set it up for an expedited hearing. Some judges will not do much while others will intervene actively if you can show that the child will be psychologically harmed by another move. In fact, you may want to have the child seen right away by a child psychologist. If you wish to discuss it with me further, give me a call at 248-353-9400.
