I have Legal Guardianship and daughter wont send grandson back

The courts in Ca. gave me legal guardianship of my then 8 year old grandson. He is now 12. Since then, my husband and I have been his only means of love and support. His mother left his sister and him and moved across country to live with her boyfriend. Her exhusband has custody of their daughter. My grandson did not belong to him so I fought for and won guardianship. Now, after sending my grandson to spend a month with his mother, she informs me that she is keeping him and enrolling him in school there. She has a son, 3, by her boyfiend. I have no means of communication with my grandson because the boyfriend and my daughter only have cell phones, not landlines. The only time I can speak with him is when she is there, listening. I managed to IM him and he said that she was pressuring him to stay. He is so confused. What is my legal option regarding this. My daughters boyfriend is abusive towards her and is an alcolholic. It is not an envioment I want my grandson in. He is suppose to fly home on the 13 of July, but I have a gut feeling he wont be on the plane. What are the law in Michigan regarding this. We moved to Az.last year to give my grandson a better envioment. Is the Ca. Judgement still in effect? Thank you.

You have to go to the police and file a kidnapping charge against your daughter. Do this without notice. Otherwise, she will run to a lawyer and obtain some document contradicting the guardianship. Even though it will be fraudulent, it will still cause problems. Bill Stern

A Michigan court should honor the California judgment. You should contact the authorities (police) if you believe he will not be returned to you. The police will want to see the judgment. If you need more info. please contact my office at (248)851-3171.
