Child custody primary goal is "permanency" as in an established custodial environment will not be disturbed absent a change in circumstances. Once a change in circumstances occurs, there are 11 "best interest" of the child factors that the court applies. There is a presumption in favor of biological parents.

Most people who act out in the manner in which you have suggested run afoul of one or two of the factors in terms of their overall functioning. "adultery" per se is not a factor. If the mother has custody (legal or physical) there is not much the court will do to prohibit her activities. Call us for a free consultation 877 887 9562
