Legal Separation and Temporary Custody

If a wife files for a legal separation can she also file for temporary custody? Story-- My brothers wife has been having a affair and for some time has been saying she was going to file for a legal separation. She filed for a both and the police told him by the paper work he can not take his baby anywhere and she has temporary custody by the papers she showed them.How can this be he has done nothing wrong need some advice on what to do.

Greetings; Your brother needs the assistance of an attorney immediately. I suspect that his spouse obtained an ex-parte order for custody. He must object to this order or he risks having it become a temporary order. I have handled many cases similar to this one.
