legal seperation or divorce

If you get a legal seperation and I have a 2 year old child do I have to move out with the baby. My husband wants a divorce but we talked about a legal seperation.

As far as your question, you can live together if you want. It is a free country. the main question is, why do you want a legal separation? What possible benefit would there be to you? Not any. If he wants a divorce, get it. Eventually, someone will have to move out. You need a good family law lawyer. Truthfully, it sounds as if your problem is not so much a legal problem as a personal one where you can't accept the fact that the marriage is over. You're lucky you found out early. You have your whole life ahead of you. Get a good lawyer, get all you're entitled to and go forward. William S. Stern

A legal separation does not help you. It gives you no advantages over a divorce,and if your husband answers the paperwork by requesting a divorce, the case will be a divorce. But you do have many laegal rights. Look at my website at loebslaw.com and feel free to write or call me.
