Can I legally take my daughter from the mother if I feel she is being mistreated or abused, I filed for custody.

If you filed for custody, there probably is some type of custody order already in place. I'd follow the order unless it was an emergency. You can also file an emergency motion for supervised visitation and to eliminate custody.
