Legal Question in Family Law in Michigan

Life Insurance

If I was the benificiary of my fathers insurance, and I had two minor brothers from the same father different mother. Would they take the life insurance from me and award it to the mother of the children, even though the children would be receiving significant sums of money from workmans comp because of my fathers work related death???

Re: Life Insurance

If you are the only beneficiary on the insurance policy, then all the proceeds go to you. If he has a will which specifies otherwise, they may try to make a claim and dispute it in probate court, but that does not mean they will be successful (they likely wouldn't, depending on facts which you have not disclosed here).

The children's award of workers' comp has nothing to do with the distribution of any life insurance proceeds.

Re: Life Insurance

if you were your fathers beneficiary, you get the funds. That is a contract between the company and your father. I thinks the other facts are unimportant. Feel free to contact me to discuss further. Tim Klisz www.kliszlaw.com
