Not married with kids and more

Me and the father to my kids have been together for 7 yrs on and off. We are not married and we have 2 kids one is 5 other is 2. We have lived with his mom when we were together up until Oct. 2000. A friend of his offered me a place and I had him check into it and we got it. Everything that we own or have is in his name. He sleeps around with just about everyone and this is the reason that it has been on/off relationship. I just found him with another women 3 weeks ago and found a personal on the comp. for him to find new sexual partners. I wish to leave but to take my stuff and the kids. I am at a total loss of what i can do could or how I could handle it in a legal matter of how the law works in a situation like this.

Dear Madam:

This is in response to your email of April 28, 2001, which was received by this office on June 18, 2001.

A person in a situation such as this could petition the court for physical custody of her minor children and request that the father pay child support for the 2 children. Additionally, if you decide to move you should establish a positive custodial environment for the children and a safe and stable home for them. Also, you should be able to take any of those personal belongings that belong to your children and yourself, should you decide to leave.

You were probably awarded custody to both children when their father acknowledged paternity.

If so then that is your guide as to what you can and can not do. If no such award of custody exists then you should go to the Friend of the Court in the county where you live to start a custody action. As far as taking your personal property you should have no problem. You may also wish to contact Legal Aid in your county for assistance. Good luck.
