Does medical/dental bill have to be fully paid for noncustodial parent to share

My son was eighteen but still in high school when I signed

a legal obligation for orthodontic treatment. The noncustodial parent had known of the need for braces but felt son was to young -- son wore a face bow for a period

of time prior to this and did not want braces. Son agreed

to braces just prior to eighteen birthday in January of 2003.

Orthodontic treatment began and financial agreement was

signed by me, the custodial parent. This information was

brought up in a referee hearing and although I can not

remember exactly what the referee said it was determined that the noncustodial parent had a legal obligation for his share of the unpaid balance. The financial agreement of the custodial parent was presented to the noncustodial parent and the court.

Now after more eighteen months - noncustodial portion has been paid he has filed a petition with the court because although I am making the monthly payments agreed to the

orthodontic bill was not fully paid by the time our child

graduated and he feels he is only obligated to that point

in time and has filed an objection claiming that the expense did not occur during the period. What are my legal

rights? I have a statement showing payments made.

You know the answer, you will argue that the expense was incurred while the child was under 18 and still was noncustodial parents financial responsibility. I recommend that you have an attorney handle this matter. For more info., please contact my office at (248)851-3171.
