Legal Question in Family Law in Michigan

MI criminal record expungement

In 2004, i was arrested for domestic violence in Michigan. This charge was dismissed in court later on that year, as i pleaded not guilty.

I would like to know if this is possibly still in my record, or must have been expunged?

P.S.

I was never arrested b4 then, and have never been after then.

Re: MI criminal record expungement

An arrest will always show on your record but all that matters are convictions. You cannot expunge an arrest record, nor would you ever need to.

If it was truly dismissed, you have not been convicted. Get a court printout showing the disposition of your case to keep for your records in case you ever need to prove you were not convicted (e.g., for employment purposes).

If you were convicted of some lesser included crime of DV, then you may have an expungement issue, however, it wouldn't be eligible until 5 years have passed from the date of conviction anyway.

Good luck!
