Legal Question in Family Law in Michigan

michigan adoption

I am currently getting a divorce in Michigan. My husband adopted my 2 kids (by different fathers)in 1999. I want to find out if the biological fathers can get their rights back? My kids do not like being with their adoptive father. What can I do to get the biological fathers rights back?

Re: michigan adoption

Those are issues that REALLY should have been decided before the adoption went through. It's not fair to the kids, and courts don't like having people flip flop on issues like responsibility for children, particuarly when there is a divorce at issue.

You may not be able to have him absolved of responsibility, because by law he is responsible for child support (totally aside from custody), until the birth fathers agree to pay child support. Even now, the court need not allow it, since the test the court must apply is what is in the best interests of the children.
