Legal Question in Family Law in Michigan

military interferrance in family matter

We are a military family. My husband moved out three weeks ago per my request. We are not discussing divorce at this time but are seeking marriage therapy while separated. His CO told him yesterday that he needs to file something-period. He is living with another member of the command and her family for free, which his command granted him permission to do. I feel this is a personal family matter. Do they have the right/authority to force this on us? Him moving home at this time is not an option but we were waiting until going through therapy to make a decision of the magnitude. We have two kids who will be affected by this.

Why is his CO telling him to file something? What does he/she mean by something? If the two of you are trying to go through counseling first, I don't see how that is the business of the military. However, I have no experience in military law. I would recommend your husband ask a local JAG office about this. They'd be able to better advise him than a CO.
