Motion to Compel

My ex-husband is fighting a raise in child support. I believe he's making more money than he's saying, so I filed a Notice to Produce Documents (tax returns, 1099's, etc...) He is 3 weeks over in getting these to me. Is the next step a motion to compel? If so, what does it need to consist of? This case has been ongoing since 3/7/01, his attorney keeps dragging it out and now claims he's ill and needs time to make sure his client is taken care of...How long must I wait? Your help would be appreciated. Thank you.

Dear Madam:

This is in response to your email of May 14, 2001, which was received by this office on June 22, 2001.

If you are unrepresented by counsel you may contact the county Friend of the Court for assistance in obtaining the documents if they have not already done so. Unfortunately, the Friend of the Court is swamped with many cases and is backlogged as to these types of matters. However, it is important to be persistent and yet patient.
